The point is not to harm the villain but to A) deter others B) create social consensus about what is acceptable and what is not and C) remove the villain from peaceful society.
If you can't trust whoever provides your security to decide who lives and dies you have much bigger problems than occasional execution of innocents while genuinely pursuing violent criminals.

life in prison does all these things, crime rate is a lot higher in states where death penalty is still legal infact.
